Is there an open-source or non open-source application that can crawl the web and look for trademarks (either text or image) or do I need to create it myself...

I suggest visiting http://tess2.uspto.gov/ . It's a US-specific site and they do have some warnings about what is and is not there.

There is an online search here: http://tess2.uspto.gov/bin/gate.exe?f=tess&state=4006:a4ikba.1.1

I'm pretty sure you have to create it yourself, as that is too specific.

For images, you may find that tineye.com does exactly what you want: You can use it to find copies of your trademarked image on the web.
