I believe with the "pay as you go" versions of the phones, you can avoid the data plan. But, to get the free phone, that usually requires a contract agreement with at least a voice plan. Data plan is required if the terms require it. That is how subsidized phones work. They give you a deal on the phone if you sign a contract that requires a certain amount of service.
Alternatively, you can always pay full price for the phone and select the plans you want to also.
EDIT: Adding some addition points from my comments:
- There isn't much you can do if the terms of Verizon's subsidy contract on that phone requires a data plan. You could get the most basic one though.
- If the data plan is useless to you, then it would most likely be much cheaper to just purchase the phone at full price and just keep your normal voice plan and you would not be under any contract.
- Any tips mentioned all depend on the contract terms of agreement if you sign one. That is where buying the phone outright is a common way around this.
