I have a Verizon Wireless cell phone, and I'd like to use New Every 2 to upgrade it to a free Samsung Omnia.

However, I don't want a data plan (WiFi is good enough for me), and the web site won't let me buy any smartphones unless I get a data plan.

Is there any way around this? I tried calling them on the phone, but I didn't get anywhere.

I believe with the "pay as you go" versions of the phones, you can avoid the data plan. But, to get the free phone, that usually requires a contract agreement with at least a voice plan. Data plan is required if the terms require it. That is how subsidized phones work. They give you a deal on the phone if you sign a contract that requires a certain amount of service.

Alternatively, you can always pay full price for the phone and select the plans you want to also.

EDIT: Adding some addition points from my comments:

  • There isn't much you can do if the terms of Verizon's subsidy contract on that phone requires a data plan. You could get the most basic one though.
  • If the data plan is useless to you, then it would most likely be much cheaper to just purchase the phone at full price and just keep your normal voice plan and you would not be under any contract.
  • Any tips mentioned all depend on the contract terms of agreement if you sign one. That is where buying the phone outright is a common way around this.

Yes. I already have (and will renew) a voice plan; I just don't want to pay for data when I already have a fast WiFi network everywhere I'll be using the phone. – SLaks Oct 1 '09 at 16:42

Look over the contract regarding the data plan. If there is no time requirement(2yrs) for the data plan. Enroll in the data plan and after the first month is over cancel the data plan.

I already thought of this, but the salesperson said that if I cancel the data plan, the smart phone will be deactivated. (Does anyone know whether that's true?) – SLaks Oct 1 '09 at 16:59
