the issue I was having was a shared DATA partition was getting corrupted by WIN8 and I was trying to determine if I needed to set BIOS to legacy mode or what the issue was so I was interesting in the cause of this

I don't think this question should be closed. Having struggled with several dual boot setups and WIN8 disk issues because of the setup I think this will be a issue for others.

I had a shared data partition WIN8 and WIN7 dual boot setup, WIN8 first starts corrupting file permissions then eventually destroys the file when you allow it to "fix" errors. Same shared drive works fine now with WIN7 and UBUNTU.

I understand - I test software so that is the only reason I didnt delete the partition. The boot manager I use is here: terabyteunlimited.com/bootit-bare-metal.htm it allows you to selectively hide partitions at boot and that should work. It seemed to solve the issue for me but like I said I had not been using Win8 much since.

I have had this experience on two different systems. The only way to avoid it was using a boot manager (I use BootIt BareMetal) that can hide the other partitions. I am pretty sure there is a bug in Win8 but everything I have seen on MS support claims otherwise. Since I have seen little real value in Windows 8 I just don't even bother with booting it anymore.

I am almost positive there is some type of bug with Windows 8 and shared data partitions. With a dual boot system and a shared data partition Windows 8 was constantly trashing the data partition, even tried reformatting. Running only Windows 7 the partition was fine. It seemed like the problem occurred with larger files, frankly I just had to give up on Windows 8 since it kept trashing data.
