I'm sorry but that's not the issue. I'm using it in a GUI. I already fixed the issue. It was that the variable in the color scheme file didn't match the file name. When VIM tries to reload the set colorscheme later it uses the value in the variable to retrieve it. When it doesn't match the file name it can't find the colorscheme. See my answer before yours.

comment Applescript to open a NEW terminal window in current space
This works but OSX still moves spaces automatically to whatever space had open terminal windows. If I disable that feature in system preferences it fixes it but now all my other applications no longer move me to a space with open windows for that app. I hate launching an app only to find that no windows appear, just the menu bar at the top shows that application has focus. So bizarre.
